PORTLAND, Ore. — An employer is not required to accommodate the use of medical marijuana, the Oregon Supreme Court ruled Thursday in a case that cost a worker his job, saying state law is trumped by federal law that classifies pot as an illegal drug.

While cautious about reports that are "solely anecdotal," Paul Armentano, deputy director and resident science wonk at the National Organization for the Reform of Marijuana Laws, lays blame for the lack of proper data at the foot of prohibition. "It is a shame that lone individuals must try and engage in the work that the medical establishment should be undertaking, yet have turned a blind eye to," he says. "Unfortunately, what we have is speculation rather than hard science, and we only have the politicization of cannabis to blame."

A recent article by the Associated Press reports:

A federal appeals court has ruled that mobile tracking devices can be attached to suspect vehicles as part of a marijuana investigation in Oregon.

The 9th U.S. Circuit Court of Appeals upheld a lower court in the case of Juan Pineda-Moreno, who argued his constitutional rights were violated when U.S. Drug Enforcement Administration agents attached devices to his sport utility vehicle.

“All I want to be able to do is grow it so that it can be tested,” Dr. Craker said in comments echoed by other researchers.

Marijuana is the only major drug for which the federal government controls the only legal research supply and for which the government requires a special scientific review.
